By purchasing products from Birddog Lighting (Birddog Distributing, Inc.), you agree to abide by the following legally binding terms and conditions.

1. Governing Law & Jurisdiction

All transactions, disputes, or claims arising from purchases made through this website shall be governed by the laws of the State of Montana, without regard to conflict-of-law principles.
You consent to the exclusive jurisdiction and venue of the courts located within Montana for resolution of any disputes.

2. Buyer’s Legal Compliance

By purchasing, you warrant that you are legally permitted to buy these products and follow all applicable local, state, federal, and international laws.
Birddog Lighting assumes no responsibility for non-compliance with such laws.

3. Liability Limitation

TO THE FULLEST EXTENT PERMITTED BY LAW, Birddog Distributing, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or intangible losses.
Total liability for any claim shall not exceed the amount paid for the product in question.
Birddog Lighting shall have no liability for incidental or consequential costs, including installation, transportation, personal injury, property damage, or related expenses.

4. Product Use & Safety

Spool Warning: Any linear lighting product packaged on a spool must be removed before connecting to power. Plugging in while on the spool voids all warranties and may pose a fire risk.
Weatherproofing: Failure to properly weatherproof outdoor lighting voids the warranty.
Surge Protection: Use of a surge protector is strongly recommended. Failure to use one may void the warranty.
Buyer assumes full responsibility for safe handling, installation, and operation of products. If uncertain, consult a licensed professional electrician.

5. Warranty Policy

Warranties exclude items that are installed incorrectly, misused, neglected, altered, or abused.
Warranty claims require submission of photos or video evidence of the defective product. Refusal to provide evidence may result in denial.
Birddog Lighting reserves discretion in determining warranty eligibility.
Products must be installed in accordance with instructions provided on packaging, in-box materials, or at www.birddoglighting.com.

All warranty claims are subject to the terms and conditions outlined in Birddog Lighting’s Warranty & Returns Policy, which is incorporated herein by reference and available at www.birddoglighting.com/warranty-returns.

6. Refunds & Returns

Returns must be made within 30 days of receipt, in like-new condition.
Refunds are subject to a 20% restocking fee unless taken as account credit.
An RMA (Return Merchandise Authorization) must be obtained before returning items.
Holiday items purchased within 30 days of the holiday are non-refundable.
Shipping costs are non-refundable.

7. Website Use

The website is provided on an “as-is” and “as-available” basis.
Birddog Lighting does not guarantee uninterrupted or error-free operation.
No oral or written advice from employees shall constitute a warranty.
You use the website at your own risk.

8. Product Display & Colors

Birddog Lighting strives for accurate product representation.
Due to variations in monitors and displays, exact color matches cannot be guaranteed.

9. Website Errors

Birddog Lighting reserves the right to correct errors or inaccuracies at any time.
Orders placed based on incorrect information may be denied or corrected.
Dissatisfied customers may return products in accordance with the Return Policy.

10. Payment

Accepted payment methods: PayPal and major U.S. credit cards (Visa®, MasterCard®, Discover®, American Express®).

11. Promotional Codes

One coupon/discount per order.
Coupons cannot be combined with other offers.
Coupons must be used before expiration and are valid for a single transaction only.

12. Shipping

Orders are subject to product availability.
Shipping is conducted in accordance with Birddog Lighting’s Shipping Policy.

13. Termination of Site Privileges

Birddog Lighting may terminate accounts or site privileges at its sole discretion.
Customers remain liable for transactions made prior to termination.

14. Force Majeure

Birddog Lighting shall not be liable or responsible for any failure or delay in performance caused by circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, fire, flood, earthquake, severe weather, war, terrorism, labor disputes, supply chain disruptions, government actions, pandemics, or interruptions of utilities or transportation.
In such events, Birddog Lighting’s obligations shall be suspended for the duration of the event.

15. Severability

If any provision of these Terms & Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
The invalid provision shall be replaced with a valid and enforceable provision that most closely reflects the original intent.

16. Entire Agreement

These Terms & Conditions, together with any policies referenced herein (including the Warranty & Returns Policy and Shipping Policy), constitute the entire agreement between you and Birddog Lighting regarding your purchase and use of products.
They supersede any prior agreements, communications, or representations, whether oral or written.

17. Modification of Terms

Birddog Lighting reserves the right to update, amend, or modify these Terms & Conditions at any time, without prior notice.
Any changes will be posted on www.birddoglighting.com, and continued use of the website or purchase of products after such changes constitutes acceptance of the revised Terms & Conditions.
